Important Notice: Early Release of Form Updates for Legislative Changes Effective Sept. 1, 2025
In response to the significant number of new laws taking effect Sept. 1 that will impact suits already pending on that date, we are releasing some updates to affected forms early for our subscribers.
When assembling forms, you may be presented with the following questions:
□ Apply legislative changes effective Sept. 1, 2025, for pending suits
□ This suit was filed on or after Sept. 1, 2025
□ Criminal proceeding commenced on or after Sept. 1, 2025
For legislative changes that became effective immediately upon enactment, forms have been unconditionally updated.
SB1404: For pending suits as of Sept. 1 and suits filed on or after Sept. 1: all Family Law orders with Required Party Information per 105.006 TFC will include an e-mail address for a party with protected information, with the option to withhold that information per 105.006(c-2).
HB1973: For suits filed on or after Sept. 1: Family Law Petitions involving children include statement that a certified copy of the birth certificate for the child has been submitted, will be submitted, or is not available and requests the respondent to provide.
SB2052: For pending suits as of Sept. 1 and suits filed on or after Sept. 1: Family Law orders involving a nonparent include option for findings for rebutting the parental presumption. New Affidavit or Declaration for Standing of Nonparent in Ch. 15.
HB2495: For pending suits as of Sept. 1 and suits filed on or after Sept. 1: Family Law orders for conservatorship have new right to designate the school a child will attend and to enroll them.
SB1923: For suits filed on or after Sept. 1: Modification of Child Support, new option for change in physical possession based on signed authorization agreement. Improved pathway for modification based on change in possession.
HB116 and HB1620: For pending suits as of Sept. 1 and suits filed on or after Sept. 1: Codes for Family Law termination grounds have been renumbered.
HB1916: For pending suits as of Sept. 1 and suits filed on or after Sept. 1: A court that renders a final decree of divorce or annulment retains continuing, exclusive jurisdiction to divide property.
SB372: Effective immediately: In Real Estate and Foreclosure forms, a Trustee signature may be made by an individual acting on behalf of an entity serving as Trustee.
SB1734: Effective Sept. 1: New chapter of forms in Real Estate for actions on fraudulent conveyance of property.
SB1119: Effective immediately: Civil Litigation Answer to Premises Liability has new defense for water park liability.
SB746 : For pending suits as of Sept. 1 and suits filed on or after Sept. 1: Guardians ad litem appointed in Guardianship forms for a “proposed ward” if no court determination of incapacity has yet been made. Changes are intended to clarify current statutes, so references to said ward are changed unconditionally.
HB1778: For criminal proceedings commencing on or after Sept. 1: Motion for Limiting Instruction under 38.37 CCP includes additional authority.
